The Association of British Insurers is pushing for government action to improve life for
personal injury claimants.
Along with extortionate and often unnecessary legal costs being attached to claims - in turn driving up premiums - it has been found that motor accident injury claims take an average of 730 days to settle. Workplace claims take up to three years to settle.
80% of claims related to car accidents were not contested which makes the above average all the more astounding; situations are not always helped by claimants visiting a solicitor first, before dealing with the insurer in question.
Solicitors work in an adversarial way and hence negotiations can become protracted and in a lot of cases, this is quite unnecessary. In the case of workplace injury this may mean a deferred return to work and claimants being forced on to incapacity benefits.
The ABI is aiming for a 75% reduction in processing time.
The government has already proposed a slicker system of timings for making claims but has so far failed to implement these.
